EB-5 Immigrant Investor Regional Center Program Renewed for 3 Years

In October 2009, Congress passed an act extending the EB-5 Immigrant Investor Regional Center Pilot Program for three years, replacing the trend of only extending the program for six months at a time. This is great news for potential investors, and provides tremendous stability and reassurance that the EB-5 program will remain in effect, unchanged and available to foreign nationals interested in immigrating to the U.S. by investing $500,000 in a USCIS certified regional center, such as the New Orleans Regional Center. Click here for more information and for answers to Frequently Asked Questions about the EB-5 program.

If you are interested in learning more about this program and about how you and your immediate family may be able to become U.S. lawful permanent residents through investment, please call the Law Office of Rana Jazayerli to discuss your options

New H-1B Visa Petitions Will be Accepted by USCIS Beginning April 1, 2010

USCIS will begin accepting petitions for H-1B temporary employment visas starting April 1, 2010 for the upcoming fiscal year.  What this means is that if you are an employer or a skilled/professional foreign national employee interested in temporary employment, visas for work beginning Oct. 1, 2010 will soon be available. Accordingly, now is the time for employers and employees to begin preparing petitions for submission.  If you are interested in applying, contact us immediately to discuss how we can prepare your petition for submission on April 1.

Lawsuit to Start-up Delayed Security Checks on Naturalization Applications

If you have had your interview but been told that a decision on your application for naturalization cannot be made because your FBI name check has not been completed, and you have been waiting months, even years, for USCIS to give you a decision, you do not have to continue to wait in vain. There is a way to compel USCIS to complete your security clearance and adjudicate your immigration or naturalization application.

Under the federal law, the government must make a decision on your naturalization application within 120 days after conducting your naturalization interview. Backlogs in FBI name checks have meant that, for many naturalization applicants, the 120 days has long since past without a decision being made. In these instances, we have successfully filed many actions on behalf of our clients in U.S. Federal Court to compel the government to adjudicate applications that have been pending far too long—that is, to compel the government to do what they are required to do under the law.

If you are one of these people, contact us to discuss your options and to see whether you might benefit from filing such an action. We are experienced litigators and are ready to help.

Revised I-9 Form

Employers who hire new employees must verify that the employee is eligible to work in the U.S. and complete a Form I-9.  A new rule that has been delayed implementation until April 3, 2009, amends the types of acceptable documents that an employer may accept to verify employment.  Upon implementation of the new rule, employers may no longer accept expired documents.. . .
